These Terms & Conditions govern your use of the website and services provided by Growth Nova Agency ("we", "us", "our"), located in Sydney, NSW, Australia. Nothing in these terms limits your rights under the Australian Consumer Law (ACL). For privacy matters, please also read our Privacy Policy.

1. Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our website or services.

2. Description of Services

  • AI-powered video content creation for social media
  • Content optimisation for TikTok, Instagram Reels and YouTube Shorts
  • Monthly subscription plans: Starter, Growth and Pro
  • A free trial video offer for eligible new businesses

3. Subscription Terms

  • Subscriptions are billed on a monthly cycle.
  • Prices (in AUD): Starter $299/mo, Growth $499/mo, Pro $899/mo.
  • No long-term contracts — you may cancel at any time with 30 days notice.
  • We may change pricing with 30 days advance notice.
  • Refund policy: we do not provide refunds for partial months, but you retain access to the service until the end of your current billing period.

4. Client Responsibilities

  • Provide raw video and photo content as reasonably requested
  • Ensure you hold all necessary rights to the content you provide
  • Provide timely feedback and approvals to keep delivery on schedule
  • Ensure your content does not violate any laws or third-party rights

5. Content Ownership & License

  • You retain ownership of all raw footage you provide.
  • Growth Nova retains ownership of its editing techniques, templates and AI workflows.
  • You receive a full license to use all finished videos for your business.
  • Growth Nova may feature finished videos in its portfolio and marketing, with your permission.

6. Intellectual Property

All trademarks, logos, copyrights and other intellectual property must be respected. You must not use any third party's intellectual property in content you provide unless you have the right to do so. Our website content, branding and materials remain our intellectual property.

7. Free Video Offer

  • One free video is available per business, with no obligation to purchase.
  • Growth Nova retains the right to use the free video in its marketing materials.
  • The free video is delivered within 48 hours of receiving your raw footage.

8. Limitation of Liability

  • Services are provided on an "as is" basis, subject to your rights under the Australian Consumer Law.
  • We are not liable for changes made by social media platforms, including algorithm changes.
  • We are not liable for specific business results (such as engagement or sales), as these depend on many factors outside our control.
  • To the extent permitted by law, our maximum liability is limited to the fees you paid in the previous 3 months.

9. Termination

  • Either party may terminate with 30 days written notice.
  • We may terminate immediately if you materially breach these terms.
  • Upon termination, you retain all content that has already been delivered to you.

10. Governing Law

These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any disputes arising from these terms.

11. Dispute Resolution

If a dispute arises, the parties agree to first attempt to resolve it through good-faith negotiation. If unresolved, the parties will attempt mediation before commencing court proceedings.

12. Privacy

Our collection and handling of personal information is described in our Privacy Policy, which forms part of these terms.

13. Changes to Terms

We may update these Terms & Conditions from time to time. Material changes will be communicated with reasonable notice, and the "Last updated" date above will be revised.
